Construction noise is a significant problem in Thailand, particularly in rapidly developing urban areas such as Bangkok, Phuket, Chiang Mai, and other cities experiencing major residential and commercial development. Pile driving, demolition, concrete mixing, and heavy machinery can generate noise levels well above 90 dB(A) — far exceeding comfortable levels for nearby residents.

Thai law regulates construction noise under the Public Health Act B.E. 2535 and local authority by-laws. In Bangkok, the Bangkok Metropolitan Administration (BMA) regulations require that noise-generating construction activities are only permitted between 06:00 and 20:00 on weekdays. Night-time construction (after 20:00) requires special permission and must comply with strict noise limits.

The Pollution Control Department has established that construction noise must not exceed 75 dB(A) measured at the boundary of the construction site during permitted working hours. Residential areas adjacent to construction sites are entitled to protection under these standards.

How to File a Construction Noise Complaint

  1. 1. Record evidence: Document the noise with video and audio recordings, noting exact dates and times. A decibel meter reading is very useful as supporting evidence.
  2. 2. Identify the responsible party: Note the construction company name, project hoarding details, and any permit numbers displayed on-site.
  3. 3. Contact the district office: File a complaint with your local สำนักงานเขต or municipality. In Bangkok, you can also report to the BMA environment department.
  4. 4. Contact the Pollution Control Department: Call PCD on 1650 for construction noise complaints, especially when noise exceeds legal limits or occurs outside permitted hours.
  5. 5. Consult a legal adviser: For ongoing or severe cases, consider consulting a lawyer about civil action for damages under the Civil and Commercial Code.

Your Rights During Construction Projects

As a resident near a construction project, you have the right to request that the construction operator comply with all applicable noise regulations. The construction permit issued by local authorities may include conditions on working hours and noise levels — you can request to view these conditions at the issuing authority.
